Our client: Hiscox Insurance Company Limited Our client's insured: Mr and Mrs LernerAlleged subsidence damage to 112 Leeside Crescent NW11 OJTWe write further to the above matter, in which we act on behalf of our client's insured in relation to subsidence damage at the Property. We are conducting an investigation into a potential recovery claim due to vegetation induced subsidence damage caused to the Property as a result of implicated vegetation, including a number of Oak trees which are under your ownership. We understand that the damage was first discovered to the Property in March 2021 and necessitated remedial works. You were notified in September 2021 and carried out a reduction to the vegetation of 30% in November 2021.We write to request additional information to assist us in our investigation into a potential recovery claim in this matter. In particular we require further information and documentation to assist in our investigations into imputed notice. As such we would be grateful if you could provide information and documentation pertaining to any vegetation-induced subsidence claims within a 2km radius of the Property for the period of 8 years prior to the damage occurring. i.e. between March 2013 and March 2021. We would also be grateful if you could confirm your vegetation monitoring scheme that was active during this period. We look forward to your response.
