I am writing to you to submit a Freedom of Information (FOI) request under the Freedom of Information Act 2000 (FOIA).My request relates to actions carried out by Barnet Council Enforcement in relation to;[Name redacted],43, Warwick Road,New Barnet,EN5 5EQBuilding applications submitted by Mr Licsey for 43, Warwick Rd.20/1092/19115/06551/RCU15/05165/PNH15/05166/PNHBelow a brief history of events;1.28/04/2017 - Application 15/06551/RCU refused 2.17/05/2017 - Enforcement notice served. 3.08/01/2018 - Appeal against enforcement notice dismissed with requirement of Demolish side and rear extension including car port 4.28/09/2018 - Prosecution proceedings commenced with court date 16/07/19. 5.25/06/2019 - Letter from solicitors representing defendant saying in the lead up to court date he has 1. Removed the Carbon sheeting on the roof and replaced with felted roof and 2. The carbon sheeting to the side of the extension has also been removed, all corrugated plastic has been removed and replaces with felt at the top and to the side of the building. 6.16/07/2019 - Defendant found guilty and fined in Willesden Magistrates Court. 7.15/10/2019 - Site visit confirms that works referred to in June letter have been completed, but the car port remains. 8.26/10/2019 - Second prosecution considered as car port remains 9.10/07/2020 - Car port remains 10.20/10/2020 - Case referred to councils solicitors for second prosecution in respect of the car port 11.10/02/2022 - In court for second time. Found guilty and fined again. 8th January 2018 the Planning Inspectorate made this appeal decision;Appeal Ref: APP/N5090/C/17/3178079, 43 Warwick Road, Barnet EN5 5EQ * The appeal is made under section 174 of the Town and Country Planning Act 1990 as amended by the Planning and Compensation Act 1991. * The appeal is made by Mr Ferenc Liscsey against an enforcement notice issued by the Council of the London Borough of Barnet. * The enforcement notice was issued on 16 May 2017. * The breach of planning control as alleged in the notice is without planning permission, construction of a side and rear extension. * The requirements of the notice are: 1 Demolish the side and rear extension. 2 Remove all material from the property resulted from the work from part 1. * The period for compliance with the requirements is 3 months. * The appeal is proceeding on the grounds set out in section 174(2)(a) of the Town and Country Planning Act 1990 as amended. Since an appeal has been brought on ground (a) an application for planning permission is deemed to have been made under section 177(5) of the Act. Summary of Decision: The appeal is dismissed and the enforcement notice upheld as corrected. I request the following:1) All communications and papers relating to the Council's two court enforcement actions against 43 Warwick Road with regards planning. 2) All communications and papers of agreements reached outside of the court case, with dates and by whom. 3) All subsequent communications and papers relating to the enforcement of the court's two decisions, including the council's decision not to enforce the court's decision.
