Private Tennis Club Tenancy in Northway Gardens in NW1
Received: 10 June 2025
If a tenant 'holds over' (ie stays in possession when the lease term expires) but keeps paying the rent, the law would usually see that as either an 'implied periodic tenancy' (which would be terminable by either party with notice equal to the period by which rent is paid) or 'tenancy at will' (terminable without notice) - My questions to Barnet are:1(a) whether the tennis club has a right to occupy the land, despite no new lease agreement, for the reasons above - (b) if so, what notice period (if any) the council would need to give the club to terminate their rental agreement should either party wish to do so.(c) Notice period if another Party wants to create a new Lease.d) What would be Barnet's objections ( if any) to another Group taking on the Tennis Club?e) has anyone else taken on the lease or 'occupation' since 2018?2. What is the current financial rental?
